This Handbook is not intended to be used as a legal document. Its aim is to set out in simple form the various procedures associated with the conditional registration of historic vehicles and prescribed left hand drive vehicles.

The statements herein should not be taken as precise, legal interpretations of the law.

FOREWORD

This Handbook contains information on the conditional registration provisions of the Motor Vehicles Act and Regulations, as they apply to historic vehicles and prescribed left hand drive vehicles.

It outlines the responsibilities of recognised motor vehicle clubs and owners of conditionally registered historic vehicles and prescribed left hand drive vehicles. It also provides some answers to many of the most commonly asked questions.

The conditions of use described in this Handbook are those applying from 1 July 1998.

The conditions of use were developed in consultation with the Federation of Historic Motoring Clubs SA Inc., and are designed to better meet the needs of recognised motor vehicle clubs and club members.

Prior to 1 July 1998 the conditions applying to conditionally registered historic vehicles and prescribed left hand drive vehicles limited their operation to events listed in a calendar of club events, in accordance with a calendar approved by the Registrar of Motor Vehicles, and on no more than 20 separate journeys under a "Separate Journey Authorisation" issued by an authorised official of a recognised motor vehicle club.

From 1 July 1998, it will no longer be necessary for the calendar of club events to be approved by the Registrar of Motor Vehicles, or for an authorised official to issue separate journey authorisations.

The conditions effective from 1 July 1998 will allow for conditionally registered historic vehicles and prescribed left hand drive vehicles to be driven for up to 90 days per year, with all journeys required to be recorded in an approved Log Book.

Eligibility for conditional registration will continue to require the owner to be a financial member of a recognised motor vehicle club.

I have no doubt that the introduction of the Log Book system, which is unique to South Australia, will make it easier for owners of historic vehicles and prescribed left hand drive vehicles to take part in club events, or just take their vehicles out for a run. Happy motoring!

INTRODUCTION

Certain historic vehicles and certain left hand drive vehicles (referred to in this Handbook as prescribed left hand drive vehicles) are eligible for conditional registration, provided:

WHAT IS CONDITIONAL REGISTRATION?

As the name implies conditional registration is a form of registration that is subject to conditions. Conditional registration applies to a range of motor vehicles, which according to their use or construction, only require limited access to the road network. Vehicles such as historic vehicles and prescribed left hand drive vehicles, that are owned by financial members of a recognised motor vehicle club, and which are only driven on a limited number of journeys each year (ie, not for everyday use), are eligible for conditional registration.

In recognition of their limited use, no registration charge is payable. The only fees payable are an administration fee, number plate fee (unless number plates have already been assigned to the vehicle) and the premium for Compulsory Third Party Insurance.

WHAT IS A HISTORIC VEHICLE?

For the purposes of the Motor Vehicles Act and Regulations, a historic vehicle is a motor vehicle:

(A vehicle will not qualify for conditional registration if modifications to the vehicle prejudice the historic integrity of the vehicle. For example, a vehicle fitted with an engine or major component/s from a different make to those originally installed, would be considered to have been significantly altered from its original design, and would therefore not be eligible for conditional registration as a historic vehicle).

WHAT IS A PRESCRIBED LEFT HAND DRIVE VEHICLE?

For the purpose of the Motor Vehicles Act and Regulations, a prescribed left hand drive vehicle is a motor vehicle:

(A vehicle will not qualify for conditional registration if modifications to the vehicle prejudice the integrity of the vehicle. For example, a vehicle fitted with an engine or major component/s from a different make to those originally installed, would be considered to have been significantly altered from its original design, and would therefore not be eligible for conditional registration as a prescribed left hand drive vehicle).

ALL VEHICLES MUST BE ROADWORTHY AND COMPLY WITH THE ROAD TRAFFIC ACT

Historic vehicles and prescribed left hand drive vehicles that are conditionally registered are not exempt from any provisions of the Road Traffic Act (unless otherwise specifically stated in the Road Traffic Regulations, or stated in a "Left Hand Drive Exemption" issued in respect of the vehicle).

Owners of conditionally registered historic vehicles and prescribed left hand drive vehicles have the same responsibilities as other vehicle owners, and must ensure that the vehicle is roadworthy at all times whilst it is being driven.

WHAT IS A RECOGNISED MOTOR VEHICLE CLUB?

A recognised motor vehicle club is a motor vehicle club that has been approved and recognised by the Registrar of Motor Vehicles, by means of a notice published in the Government Gazette, in accordance with Clause 3 (3), Schedule l, of the Motor Vehicles Regulations 1996.

RECOGNITION OF A MOTOR VEHICLE CLUB

An application for recognition of a motor vehicle club must be in writing, and addressed to:

However, if the application is approved, financial members will not be eligible to apply for conditional registration until such time as the name of the recognised motor vehicle club is published in the Government Gazette, in accordance with Clause 3 (3), Schedule 1, of the Motor Vehicles Regulations 1996.

The Registrar of Motor Vehicles must be advised, in writing, if an official appointed by the club to approve applications and/or issue Log Books, resigns, or is replaced by another official, together with the name of the replacement official/s.

HOW TO APPLY FOR THE CONDITIONAL REGISTRATION OF A HISTORIC VEHICLE OR PRESCRIBED LEFT HAND DRIVE VEHICLE

An applicant for the conditional registration of a historic vehicle or prescribed left hand drive vehicle must be a financial member of a recognised motor vehicle club.

The applicant must complete an "Application for Registration and Third Party Insurance" (Form MR1). The application may be submitted at any Registration and Licensing office, but must be accompanied by either:

completed and issued by an authorised official of the recognised motor vehicle club of which the applicant is a financial member, and the prescribed administration fees and Compulsory Third Party Insurance Premium. An authorised official must not approve his or her own application.

(Forms MRl6 and MRl6A may only be issued by the authorised official if he or she is satisfied as to the eligibility of the vehicle, in terms of the year of manufacture and the absence of significant modifications from its original design).

In addition to the above, an application for the conditional registration of a prescribed left hand drive vehicle must be accompanied by a "Left Hand Drive Exemption" issued by Road Transport Assessment and Safety, Kateena Street, Regency Park.

(Historic vehicles are not required to be inspected by Transport SA, or the South Australia Police, before registration is effected. This includes historic vehicles from interstate, overseas and those not previously registered in South Australia).

Where a historic vehicle or prescribed left hand drive vehicle has not been previously registered in this State, or the previously issued registration number is not known, or is no longer available for issue, general series number plates [alpha-numeric) will be issued. However, an owner may apply to the Registrar of Motor Vehicles for the issue of number plates from the range of Special Number Plates, including "S and R series", "Historic", "Custom", "Personalised" and "Premium" number plates.

No other number plates, apart from those issued by the Registrar of Motor Vehicles, may be displayed on a conditionally registered historic vehicle or prescribed left hand drive vehicle.

A historic vehicle or prescribed left hand drive vehicle may be registered for l, 2 or 3 years, at the option of the applicant.

HOW TO APPLY FOR THE ISSUE OF A LOG BOOK

Once the historic vehicle or prescribed left hand drive vehicle has been conditionally registered, the owner is required to apply to the recognised motor vehicle club which authorised registration, and present the Certificate of Registration to the authorised official.

The Log Book* issued by clubs is sufficient to record the journeys for a period of up to three years. At the end of the third year of registration (from the initial issue of the Log Book), the owner will need to apply to the authorising club for the issue of a new Log Book.

A person to whom a Log Book has been issued must ensure that the section of the Log Book which contains details of club membership is updated each year at the time of renewal of membership. This requires the authorised official to enter the period of membership in the Log Book, and to date, stamp and sign the entry.

*The Registrar of Motor Vehicles has approved the Log Book which is published and distributed by the Federation of Historic Motoring Clubs SA Inc.

DUTIES OF RECOGNISED MOTOR VEHICLE CLUBS WHEN ISSUING LOG BOOKS

The authorised club official, when issuing a Log Book, must:

CONDITIONS OF USE

The operation of a conditionally registered historic vehicle or prescribed left hand drive vehicle is subject to the following conditions:

A person who drives a conditionally registered historic vehicle or prescribed left hand drive vehicle on a road must:

RECORDING JOURNEYS IN LOG BOOK

Each journey undertaken in a conditionally registered historic vehicle or prescribed left hand drive vehicle must be recorded in the Log Book issued by the recognised motor vehicle club, in respect of the vehicle.

The date of the journey and a brief description of the journey must be recorded before each journey commences.

The driver must also sign the Book (next to the Particulars of Use) before each journey commences.

RENEWAL OF REGISTRATION

An invitation to renew the registration of a conditionally registered historic vehicle or prescribed left hand drive vehicle will be forwarded to the registered owner some five to six weeks prior to the expiry date.

An application to renew the registration will not require further approval from the recognised motor vehicle club which originally approved the registration. However, the applicant/owner must continue to be a financial member of a recognised motor vehicle club and, once the renewal is paid, ensure that the current period of registration is endorsed in the Log Book.

The registration of a historic vehicle or prescribed left hand drive vehicle may be renewed for 1, 2 or 3 years, at the option of the applicant.

REGISTRATION IS NOT TRANSFERABLE

The registration of a conditionally registered historic vehicle or prescribed left hand drive vehicle cannot be transferred to another owner, even if the new owner is also eligible for conditional registration. Where a change of ownership occurs, the registration must be cancelled. The Log Book issued in respect of the vehicle must be returned to the club which last confirmed financial membership for cancellation.

CANCELLATION OF REGISTRATION

The registered owner of a conditionally registered historic vehicle or prescribed left hand drive vehicle may apply to cancel the registration at any time. However, as no registration charge is payable for conditional registration, there is no refund on the cancellation of the registration. The Log Book issued in respect of the vehicle must be returned to the club which last confirmed financial membership for cancellation.

PENALTIES FOR CONTRAVENTION OF CONDITIONS

A person must not contravene or fail to comply with a condition of registration. Penalty - a fine up to $500.00.

Where a person has been convicted of contravening or failing to comply with a condition of registration, the Court may order, in addition to any penalty it may have imposed, that the convicted person pay to the Registrar of Motor Vehicles the whole of the prescribed registration fee that would have been payable in respect of the period of registration during which the offence was committed, had the motor vehicle not qualified for conditional registration, together with the stamp duty that would have been payable by the convicted person upon the application for that period of registration, had the motor vehicle not qualified for conditional registration.

USE OUTSIDE OF SOUTH AUSTRALIA

A conditionally registered historic vehicle or prescribed left hand drive vehicle may be driven in another State or Territory, provided:

MEMBERSHIP OF RECOGNISED MOTOR VEHICLE CLUB

The owner of a conditionally registered historic vehicle or prescribed left hand drive vehicle must, at all times during the period that the vehicle is registered, be a financial member of a recognised motor vehicle club. On the renewal of membership, the owner must ensure that the Club Membership Record appearing in the Log Book is updated accordingly.

If the registered owner of a conditionally registered historic vehicle or prescribed left hand drive vehicle ceases to be a financial member of a recognised motor vehicle club, at any time during which the vehicle is registered, the owner must not drive the vehicle, or allow any other person to drive the vehicle until such time as the owner is again a financial member of a recognised motor vehicle club. (Driving or causing the vehicle to be driven, whilst the owner is not a financial member of a recognised motor vehicle club, is a contravention of the conditions of registration - see PENALTIES FOR CONTRAVENTION OF CONDITIONS above.

The registered owner of a conditionally registered historic vehicle or prescribed left hand drive vehicle, who changes membership from one recognised motor vehicle club to another, must ensure that the change of membership is entered in the Log Book issued in respect of the vehicle.

SPECIAL EXTENSION OF CONDITIONS

If specifically requested by the owner (either at the time of initial registration, at renewal, or at any time during the currency of a registration), the Registrar of Motor Vehicles may vary the conditions to allow the owner, in addition to the 90 days use per year, to drive the vehicle for short journeys, for the purpose of re-locating the vehicle from one part of his or her property to another part of that property, or enabling another vehicle to be moved to or from that property. (If approved, these short journeys are not required to be recorded in the Log Book).

STATIONERY

Supplies of the forms "Approval to Register Conditional Historic Vehicle" (Form' MRl6) and "Approval to Register Conditional Left Hand' Drive Vehicle" [Form MRl6A) may only be obtained by recognised motor vehicle clubs from the Co-ordinator, Product Marketing, Registration and Licensing, 60 Wakefield Street, Adelaide 5000.

Applications for the supply of these forms must be made in writing, on club letterhead. (Clubs may request the Co-ordinator to either post the forms to the club, or for the forms to be forwarded to any Registration and Licensing office for collection).

Recognised motor vehicle clubs may obtain Log Books for historic vehicles and prescribed left hand drive vehicles by applying, on club letterhead, to the Secretary, Federation of Historic Motoring Clubs SA Inc., PO Box 703, Plympton, 5038. (A fee is charged for printing and posting).

Authorised officials of recognised motor vehicle clubs responsible for the custody and issue of Log Books must ensure that supplies of unissued Log Books are stored in a secure place at all times. Any loss of unissued Log Books must be immediately reported to the Registrar of Motor Vehicles and the Federation of Historic Motoring Clubs SA Inc.

WITHDRAWAL OF RECOGNITION

If satisfied that there is good cause to do so, the Registrar of Motor Vehicles may withdraw the recognition of a motor vehicle club, with effect from a date specified in a notice published in the Government Gazette.
